Allgemeine Geschäftsbedingungen / Terms of Service

1. ALLGEMEINE BEDINGUNGEN

  • Alle Zeichnungen können bzw. werden meine subtile Signatur erhalten, die Sie nicht entfernen dürfen (Ausnahmen wären Icon, Logo oder Patch Designs).
  • Möglicherweise nehme ich den Zeichenprozess auf und lade ihn auf Instagram als Reel hoch. Falls es aber z.B. ein Geschenk werden soll, werde ich mich nach Absprache zurückhalten, um die Überraschung nicht zu verderben.
  • Ich habe das Recht jede Auftragsanfrage abzulehnen, falls ich mich aus irgendeinem Grund damit unwohl fühle.



2. BEZAHLUNG

  • Als Währung wird nur EUR akzeptiert und es kann über PayPal oder SEPA Überweisung bezahlt werden. 
  • Aufträge können nach Skizzenabnahme entweder zu 100% bezahlt oder in 50% Anzahlung nach Skizzenabnahme und 50% Restzahlung nach Fertigstellung aufgeteilt werden.
  • Senden Sie mir keine Bezahlung, bevor ich Ihnen eine Auftragsbestätigung geschickt und Sie um Zahlung gebeten habe.



3. ARBEITSABLAUF UND LIEFERUNG

  • Ich werde Sie benachrichtigen, wenn ich mit Ihrem Auftrag (nach Skizzenabnahme) begonnen habe, wodurch Sie Ihr Recht auf vollständige Rückerstattung verlieren (siehe weitere Info dazu unter Punkt 7 weiter unten)
  • Ich werde Ihnen Updates schicken, um Ihre Rückmeldung und Änderungswünsche in die Arbeit einzubeziehen.
  • Die Anzahl der Updates hängt von der Komplexität des Werkes ab.
  • Während der Rückmeldungsphase werden die Bilder mit einem Wasserzeichen versehen und sind generell etwas kleiner als das fertige Werk.
  • Die Arbeits- bzw. Lieferzeit für den Auftrag liegt in der Regel zwischen 1 Woche und 3 Monaten, abhängig von Faktoren wie der Größe und Komplexität des Werkes, der weiteren Auftragslage und Messe Saisons.
  • Falls etwas Unvorhergesehenes den Arbeitsablauf verlangsamen und die Lieferzeit verlängern sollte, werde ich Sie sofort benachrichtigen.
  • Wenn das Werk fertig ist, erhalten Sie je eine vollauflösende und eine webseitenfreundliche Version via E-mail.
  • Traditionelle Werke werden per Post verschickt, ohne zusätzliche Scans.
  • Sie können es auch selbst abholen, wenn Sie es nicht per Post erhalten wollen. Vereinbaren Sie aber vorher bitte einen Termin mit mir.



4. ÄNDERUNGEN

  • Je Arbeitsschritt sind Rückmeldephasen und je max. 2 Änderungen im Preis mit inbegriffen.
  • Zusätzliche Kosten fallen an, wenn mehr Änderungen verlangt werden, besonders wenn ich noch etwas am fertiggestellten Werk ändern soll, das vorher abgesegnet wurde - es sei denn, es lag an einem Missverständnis meinerseits.



5. COPYRIGHT / NUTZUNGSRECHTE

Wenn nichts anderes in einem Vertrag festgehalten wurde:
Ich, Shari Bongardt (die Künstlerin), behalte alle Urheberrechte am erstellten Bild, nicht der Käufer. Daher bin ich befugt das urheberrechtlich geschützte Werk wie folgt zu benutzen:

  • mich überall damit zu bewerben
  • es in Büchern zu veröffentlichen (z.B. in Artbooks)
  • es überall zu präsentieren (z.B. meiner Webseite oder meinen Sozialen Medien)
  • es egal wo hochzuladen



Der Käufer darf:

  • das Werk für persönliche Zwecke benutzen, es sei denn, wir haben uns auf etwas anderes geeinigt. (Sie können es z.B. auch auf Ihren Sozialen Medien, Profilen, Foren etc. posten).
  • das Werk drucken lassen und die dargestellten Charaktere als sein Eigentum bezeichnen, aber nicht das Werk selbst.
  • das Werk für Eigenwerbung benutzen. Sie müssen mich nicht nennen, aber ich würde schätzen wenn Sie es täten.
  • das Werk auf dem eigenen YouTube Kanal und in monetarisierten Videos benutzen, solange das Werk selbst  nicht das Hauptthema für den Verdienst am Video ist.



Folgendes gilt als Verletzung des Urheberrechts:

  • das Vervielfältigen des geschützten Werks für kommerzielle Zwecke - also um damit Geld zu verdienen.
  • das Kunstwerk als Ihr eigenes Werk auszugeben
  • das Entfernen meiner Signatur vom Werk
  • das Bearbeiten meines Werks ohne meine Zustimmung


  • Ich behalte das volle Urheber-/Nutzungsrecht für das Kunstwerk, wenn nicht anders vereinbart (Kommerzielle Nutzungsrechte können jederzeit erworben werden.)



​6. KUNDENZUFRIEDENHEIT

  • Ich werde alles was ich kann tun, um meine Kunden glücklich zu machen!
  • Falls Sie irgendein Problem mit ihrem Auftrag haben, bitte sprechen Sie mit mir, sodass wir gemeinsam eine Lösung finden können.

Wenn Sie mich vorher fragen, kann ich manche Bedingungen ändern, z.B. wenn der Auftrag nirgendwo gepostet werden soll.



7. RÜCKERSTATTUNG / STORNIERUNGS BESTIMMUNGEN

  • Falls ich aus irgendeinem Grund Ihren Auftrag nicht mehr ausführen kann, erhalten Sie eine volle Rückerstattung.
  • Falls Sie Ihren Auftrag stornieren bevor ich mit der Arbeit begonnen habe, erhalten Sie eine volle Rückerstattung.
  • Der Käufer erhält keine volle Rückerstattung, wenn ich bereits mit der Arbeit am Auftrag begonnen habe:
  • Wenn vom Käufer schon 100% des Preises bezahlt wurden, behalte ich 50% und erstatte die anderen 50%.
  • Wenn vom Käufer 50% angezahlt wurden, wird diese Anzahlung nicht zurückerstattet.
  • Bei einer Rückerstattung, beantragen sie bei Paypal keine Rückbuchung. Ich überweise Ihnen das Geld selbst.
  • Falls Sie bei Paypal, egal wann, ohne Erlaubnis eine Rückbuchung anfordern, verlieren Sie alle bisher genannten Rechte an Ihrem Auftragswerk. Ich werde die volle Befugnis haben von dem Kunstwerk in jeglicher Form zu profitieren. Ich werde die Rückerstattung stornieren und Paypal unsere Auftragsabsprachen schicken, damit klar ist, dass ich für Sie gearbeitet habe. Sie werden außerdem auf meine Blacklist gesetzt, wodurch Sie mich nicht mehr beauftragen können.

Falls Sie als Käufer irgendeine dieser obengenannten Regeln brechen, verlieren Sie alle oben genannten Rechte an dem Auftragswerk, dass von mir, Shari Bongardt (der Künstlerin), geschaffen wurde, und ich werde die volle Befugnis haben von dem Kunstwerk ganz nach Bedarf zu profitieren.

Falls Sie mit einem dieser Punkte Probleme haben, können wir diesen gern vor Beginn und Bezahlung der Arbeit besprechen.

​Was bekommen Sie?

  • erste Entwürfe, bei denen Sie entscheiden müssen mit welchem ich fortfahren soll (je nach Komplexität wird es mehr oder weniger Entwürfe geben)
  • Skizzen bzw. finale Skizzen, die Sie abnehmen müssen, bevor ich weiterarbeiten kann
  • Einblick und Mitspracherecht in Bezug auf die Farbplanung (abhängig von der Komplexität des Werks)
  • Vollauflösende Datei (ca. 210 x 297 mm (DIN A4) bei 300 DPI) des finalen Werks und eine kleinere Version für Webseiten. Das finale Dateiformat ist für gewöhnlich PNG.



1. GENERAL TERMS

  • All drawings (besides icons, logos or patch designs) may or will include a subtle sign that you may not remove .
  • I might record the drawing process and post it as a Reel on Instagram. If it's supposed to be a present though, I will of course hold back to not ruin the surprise. Just tell me beforehand.
  • I have the right to reject any order that I do not feel comfortable drawing for any reason.




2. PAYMENT

  • Currency accepted is EUR only and can be paid through PayPal or SEPA bank transfer. 
  • Commissions can be paid either 100% after sketch approval or split 50% after sketch approval and 50% after completion.
  • Don't send me any payment before I have agreed to give you a slot and requested you to send me the payment.




3. PROCESS AND DELIVERY

  • I will notify you when I have started on your commission and you, therefore, lose the rights to a full refund (see point 7 further below for more info on refunds)
  • While I'm working on your commission I will send updates to review with you to make sure I incorporate all of your feedback.
  • The amount of reviews depends on the complexity of the work.
  • During the reviews, you will see work-in-progress and these images will usually include a watermark and be smaller than the finished piece.
  • The time it takes to finish your commission varies from
    1 week to 3 months depending on factors such as the size and complexity of the commissioned piece, other work and con seasons.
  • If anything comes up that will slow the progress of the initially estimated delivery time I will let you know asap.
  • Once the piece is finished you will receive the full-resolution image along with a web-friendly size via E-mail.
  • If it is a traditional artpiece, it will be send to you via mail, with no additional scanned files whatsoever.
  • You can also pick it up yourself, if you don't want it to be sent by mail. Please schedule a suitable time with me beforehand.




4. REVISIONS

  • There is a review phase and a max. of 2 rounds of changes per workstep included in the price.
  • A fee will be added if you want more changes, especially if you want something changed on the final drawing, which was approved beforehand - unless a misunderstanding from my side has been made.




5. COPYRIGHT / USAGE POLICY

If nothing else was agreed upon in a contract:
I, Shari Bongardt (the artist), claim the rights to the produced drawing, not the buyer. Therefore I am allowed to use the copyrighted artwork to:

  • Promote myself with it everywhere
  • Publish books with it (artbooks, etc.)
  • Display it everywhere to my liking (website, social media, etc.)
  • Post it wherever I want



The buyer is allowed to:

  • Use the commissioned piece for personal use unless agreed otherwise (you can upload it on all your social media profiles, forums, etc.)
  • Print the artwork and claim the character(s) as their own, but not the artwork itself.
  • Use the artwork to promote themselves. You are not forced to give me credit when you post it but it is very appreciated.
  • Use the artwork on their Youtube channel and in monetized videos as long as the artwork itself is not the main subject for the earnings.




The following is considered copyright infringement:

  • Reproducing/using the copyrighted artwork commercially - means making money off it in any way.
  • Claiming the artwork as your own
  • Removing my signature from the artwork
  • Altering the artwork without my consent


  • I reserve the full rights to the image and it's use/distribution unless otherwise agreed upon (rights to the image for your commercial use may be purchased at any time).



​6. CUSTOMER SATISFACTION

  • I will do everything I can to make my customers happy!
  • If you have a problem with anything in regards to the commissioned piece please tell me right away so we can find a solution together.

I am willing to change some of my terms for you if you ask before I start on your commission. If you, e.g., do not want me to post your art anywhere, we can discuss this.



7. REFUND / CANCELLATION POLICY

  • If for any reason I am unable to start or finish your commission you will receive a full refund.
  • If you cancel your order before I started it, you can get a full refund.
  • The buyer is not allowed a full refund once I started working on the commission:
  • If the buyer paid 100% upfront, I will keep 50%, the other 50% will be refunded.
  • If the buyer paid 50% as a deposit, they will not be refunded.
  • If you are getting a refund, do not request a Paypal chargeback. I will transfer the money back to you myself.
  • If you request a Paypal chargeback at any point when you were not allowed to ask for a refund you will lose all beforementioned rights to the commissioned piece and I will have the full right to profit further from it in any way. I will decline the chargeback and supply Paypal with our conversations in which we talk about the commission as evidence that I have completed work for you. Furthermore, you will be blacklisted for commissioning me again.

If the buyer breaks any of the points stated above they will lose all the beforementioned rights to the artwork commissioned by me, Shari Bongardt (the artist), and I will have the right to profit further from the commissioned artwork in any way I see fit. If you have a problem with any of these statements, they may be changed if discussed with me prior to paying your commissioned piece.

​What do you get?

  • Drafts/mockups that you must decide which one I should continue with (depending on the complexity of the commission there might be fewer or more drafts)
  • Sketch and/or final sketches that you must accept before I continue the work
  • Insight and involvement in color plan (depending on the complexity of the commissioned piece)
  • Full-resolution file (approx. 210 x 297 mm at 300 DPI) of final drawing and a smaller version for internet upload. Final file formats are usually PNG.
